Mediation

Mediation is the process where a third party assists in the dispute resolution between the parties to assist them in reaching an agreement.

Process of Mediation
Mediation affords the parties an opportunity to come together with the assistance of an independent third party to negotiate in good faith to resolve their differences. Any solution reached is voluntary. The parties are encouraged to try and reach a settlement if possible but they will never be compelled to settle; you always have a right to have a judge hear your case. A party has the right to have their attorney present, assist them, and review any settlements.
Role of the Mediator
A mediator is an impartial person who will facilitate a resolution to the issues. A mediator is not a judge and will not decide your case. The mediator will generally meet with each party separately and at some point may ask the parties to meet together if they feel comfortable doing so. The mediator cannot give legal advice. Generally, the parties share the cost of the mediator.
